Documents that must be submitted to YGM for OK1 determination regarding status certificate applications, with which a determination agreement has been made

OKS Communiqué Article 6

(1) In applications for approved person status certificates, the following documents must be submitted to the YGM with which a determination agreement has been made for OK1:

a) OK1 determination request form in Annex-1,

b) Trade registry information form prepared in accordance with the sample in Annex-2 and approved by the trade registry office,

c) Originals of criminal record documents received to be submitted to the official institution within two months at the latest from the date of determination agreement for OK1 determination of persons specified in subparagraph (a) of the first paragraph of Article 23 of the Customs Regulation, and originals of undertakings signed by the relevant person or the chairman of the board of directors stating that they have not been convicted of crimes specified in subparagraph (a) of the first paragraph of Article 23 of the Customs Regulation, for foreign nationals who permanently reside abroad, in accordance with the sample in Annex-3,

ç) Throughout Turkey Regarding the proof of no finalized social security premium debt, for OK1 determination, a document obtained from the “e-no debt document” option regarding the works that are not subject to tender within the “e-no debt” application of the Social Security Institution within one month at the latest from the date of determination contract, including the trade name and tax number for legal entities, and name and surname and T.R. for real persons. the identity number, the bar-code and reference number produced electronically by the relevant institution, the date and time the document was received over the internet and information that the query was made throughout Turkey, “e-no debt document” for works that are not the subject of tender or the original letter received from the relevant units of the Social Security Institution within one month at the latest from the date of the determination agreement for OK1 determination, in accordance with the sample in Annex-4/A,

d) The original letter received from the affiliated tax office and the transferred tax offices within two months at the latest from the date of the determination agreement for OK1 determination, indicating that there is no finalized tax debt in accordance with the tax legislation,

e) According to the records of the affiliated exporters' union, the originals of the performance and reliability forms prepared separately for two periods of twelve months, within two years from the first day of the month of the determination agreement for OK1 determination, in accordance with the sample in Annex-5, by the Turkish Exporters' Assembly or the affiliated exporters' union,

f) In case the facilitation regarding the type of control of the declaration in the first and third paragraphs of Article 42/A will be used, the original or a copy approved by the institution or notary public of one of the following documents regarding the condition of being a manufacturer, R&D center or commercial air transportation company conducting maintenance and repair activities in the first paragraph (a) of the same article:

1) Industrial registry certificate issued by the provincial directorate of the Ministry of Science, Industry and Technology in the province where the production site is located or an approved capacity report obtained from the registered chamber of industry and/or commerce,

2) In cases where it is not possible to issue a capacity report in accordance with the relevant legislation, an expert report containing the total power (HP) of the machines used by the company, the number of workers and the production amount to be issued and approved by the affiliated chamber of industry and/or commerce,

3) R&D center certificate issued by the Ministry of Science, Industry and Technology,

4) For persons conducting commercial air transportation activities, a document regarding repair, maintenance and maintenance activities issued by the General Directorate of Civil Aviation.

g) Original report or notarized copy of the report prepared comparatively by a certified public accountant as a result of the examination of the applicant's financial structure based on the last two years and concluded positively, in accordance with the sample in Annex-6,

ğ) (Amended: RG-30/5/2022-31851) Original letter of the monthly premium and service documents that have expired as of the date of the OK1 determination contract, in accordance with the sample in Annex-4/B, regarding the verification of the number of workers,

h) (Repealed: RG-19/6/2021-31516)

(2) In applications for status documents made by DTSŞs and SDŞs, all documents other than the documents specified in subparagraphs (e), (f) and (ğ) of the first paragraph are required.

(3) In applications for status certificates made by group exporters, all documents issued on their behalf, except for the documents specified in subparagraph (ğ) of the first paragraph, and the documents specified in subparagraphs (b), (ç), (d), (e) and (ğ) of the first paragraph issued on behalf of each of the group manufacturers on whose behalf exports are declared in foreign trade transactions by the group exporter, are required. The facilitations regarding the type of control of the declaration in the first and third paragraphs of Article 42/A will be used.
